How come no one is talking about the thousands of lawsuits currently filed in Florida against insurers who use the major glass Networks? One Network’s clients seem to be the most targeted?
This information is all public. So, how come no news coverage? No discussions.

Win or lose, because of the “indemnification” provisions they undoubtedly signed up for, these thousands of lawsuits could cost the one network millions.

We are one of "those" Florida shops and can currently account for 907 active suits in that group of thousands you speak of, Wondering......we too are wondering....
Another 55 lawsuits or so filed in the past week. And still nothing from AGRR. As OUCH mentioned, this will hurt the big “S” to the tune of about four figures each case. You do the math: at least 3500 times four figures.
Wonder how those clients are taking it?
Heck, even the big “L’s” customers are being sued.

BRAVO, how come?, for posting these. Our company is on this list and I can tell you that those are only suits that were filed on our behalf for one day. Almost every day, a new group goes out. We currently hover around 1,000 individual active suits. Your observation about a certain network's dominance on this list is right on the money.
There is definitely a story here. Florida is one of the largest markets in the nation and MUCH is going on behind the scenes that the rest of the industry should be made aware of. The TPA's and their insurance companies are hitting a brick wall with direct bill shops here in their attempt to force discounted pricing on us. Where are you AGRR/Glassbytes???
The suits are just part of the story....there are also hundreds of jobs in Appraisal/Umpire settlement status at any given time.
Why are there so many suits??????
Because we refuse to accept attempted forced price fixing and demand to be paid at a fair and reasonable rate.
The story of the glass shop who wins doesn't fit the glass magazines agenda.
We are counsel of record for several of the matters listed below. We have been involved with glass litigation since its inception in the state of Florida. We have successfully resolved over 5000 glass claims and negotiated several going forward business deals. We continue to have great success and pave the way for glass shops to operate independently in Florida. Recently, we obtained a ruling requiring a large insurance company to disclose its contract with the Big S.
Is there a story here, absolutely. How much it applies to other states is questionable as the applicable laws for each state are different. However, we would be more than happy to write an article if asked and will be in Reno for the upcoming convention.
So, why doesn't AGRR do a story? And, why is this not a seminar in Reno?

There is a seminar in Reno covering this topic on Thursday, Oct 1 at 9am - 10am
titled: Strategies to retain business: Anti-Steering, Arbitration and Appraisal Workshop. Chuck Lloyd and Don Munro will discuss litigation, arbitration and appraisal in regard to billing and short pays to auto glass shops. Litigation and appraisal have both been successful in Florida, and appraisal has been successful in several other states.
The numbers of active legal action are over 10k+ in FL. In some cases, at settlement it cost the insurance company millions in legal fees for 1k-1500 claims.
No offense to Chuck, but we heard his story. And he hasn't filed thousands of suits. And he hasn't always been successful.

Several lawyers are successful in Florida recovering additional payments on short pays. Appraisals have been successful against several insurance companies in Florida as well. The question was about the Glass Show in Reno covering these topics. Other states do not have the same rules where glass shops are represented effectively for free by their lawyer. What is happening in Florida? That is the question. Straight forward and simple. Correct me if I am wrong, but neither Chuck nor this co-presenter is from that state.
So, how did Florida accomplish whatever it did to put those boys in Columbus in such a deep dark hole. And can it be replicated elsewhere; maybe not right away, but was there a process that we all could benefit from?
Inquiring minds would like to know.

Is there a story here, absolutely. How much it applies to other states is questionable as the applicable laws for each state are different. However, we would be more than happy to write an article if asked and will be in Reno for the upcoming convention.

Please consider this an invitation to write your article. I, for one, would be very interested. I would like to know if their contract was based on the Guaranteed Average Invoice (GAI)scheme. Based on past testimony in a case involving USAA in SC, USAA admitted that they only had a GAI contract with Safelite's claims admin. division and nothing with the "fulfillment" division.
TPA's that negotiate GAI contracts are biased and as such are actually competitors to service providers and use their positions to intimidate and deceive both, consumers and service providers.
I would like to see an audit of how much Safelite was paid on the average for claims "fulfilled" by Safelite shops as compared to the average paid to Indy's that joined Safelite's network and the average paid to truly independant shops not participating in Safelite's network. I believe it would show that Safelite is a willing co-conspirator where the insurer uses a service provider that only represents less than 20% of the market to dominate the majority rest of service provider market and to illegally depress and control prices.
The rates being offered by the top tier insurers for repairs have been stifled for twenty years and in some cases are less than what offered twenty years ago. Fortunately, we are finally starting to see the light.
Amorginos and Barrows are a great firm. I have recently been working with them and they are on top of things and very informative. They have looked out for the best interest of my company.
We use Reeder and Nussbaum in St Pete for litigation and Auto Glass Appraisal Service out of Tampa for appraisals and are very pleased with their results and representation as well. The bottom line is you need a good attorney, one who has experience with glass claims, and an experienced Appraisal service to effectively direct bill. The rest is up to you........

You would seem to need more than that. You would need a legal environment like Florida's. There the shops appear to have no downside. If they win, they appear collect ALL their damages; not having to use a portion to pay attorney fees. If they lose, they lose nothing. In other words, all upside. I may be wrong. If only we had a way to learn more. You know, an article or a seminar... Oh wait, someone else has already asked those questions.
Not Quite is right on the money. Florida is the perfect storm when it comes to this type of litigation.

Can it be true that ONE insurer has settled with ONE Florida glass business claiming short pays, leaving this ONE insurer with a legal bill exceeding $1 million for the expenses incurred by that ONE glass business? And, did that ONE glass shop also collect its entire short pay amount over and above those legal bills?

I certainly don't know, as I have not taken the time to research it to find out.
But I do know one thing: IF what you pointed out IS true, then it CLEARLY shows the extent an insurer will go to, the money they will spend, and the worth they assign to DEFENDING short payments.
In other words, the amount they're short paying is worth a whole lot more than the million to defend it, and remember, you pointed out ONE insurer. Imagine the sum for a whole bunch of them.

Mark1 has it right AGAIN! On that same line I wonder What amount was the short pays, VS what they spent do defend it.
I have seen first hand, a certain ins co send an attorney, over 200 miles from a metro area to defend an Arbitration in a rural area from a short pay of around $120.00. So after they paid the attorney several thousand to LOSE in arbitration and then they do it again and again and lose again and again. It is just comical. BUT the point is they can afford to spend thousands or millions to fight a few hundred or several thousand now that is the numbers I would like to decipher.
I think it shows they are still WAY ahead because too few shops fight for fair payments or fight to not have their invoices altered.
Ahh, I must not have been clear. The legal fees referenced above was the amount paid to the suing SHOP'S Attorneys. The insurers legal bill was over and above this amount.
And the question is how much of BOTH legal bills will be reimbursed to the insurer by the involved network?
Once again, one shop, one set of short pays (an additional amount paid by the insurer) and one insurer.
There are thousands of these lawsuits (look it up). That has got to hurt no matter how big you are.
