New Danger in Florida Senate

This is a recent amendment to Senate Bill 252 by Senator Christopher Smith. It goes to committee tomorrow Morning.


The Committee on Rules (Montford) recommended the following:

Senate Amendment (with title amendment) 1

Between lines 91 and 92 3 insert:

Section 4. Section 627.7288, Florida Statutes, is amended to read:

627.7288 Comprehensive coverage; deductible; not to apply to motor vehicle glass.—The deductible provisions of a any policy of motor vehicle insurance, delivered or issued in this state by an authorized insurer, providing comprehensive coverage or combined additional coverage:

(2) Apply to damage to the windshield of a motor vehicle covered under a commercial motor vehicle insurance policy, unless the windshield is repaired by a motor vehicle glass replacement company approved by the insurer. Each insurer shall maintain a list of approved motor vehicle glass replacement companies and shall make the list available to insureds electronically on the insurer’s website or in a hard copy format.

IF YOU READ THIS CLOSELY YOU WILL DISCOVER THAT SAFELITE AND THE INSURANCE COMPANIES ARE TRYING TO HAVE THE DEDUCTIBLE APPLIED TO ANY REPLACEMENT THAT IS DONE ON A COMMERCIAL VEHICLE BY A SHOP THAT THEY DO NOT APPROVE. THE NEXT STEP WILL BE TO APPLY THE DEDUCTIBLE TO ALL REPLACEMENTS IN FLORIDA DONE BY SHOPS THAT ARE NOT ON THEIR SO CALLED "APPROVED LIST".

The fact it was there says it had "legs". If infact it has been removed then great someone is paying attention. Again IGA, If you blow this IGA is DONE! If the IGA is not on top of these issues then the fact you even exist is MOOT!

The companion bill 1064 in the Florida Senate to House Bill 669 is likely going to the Senate Judiciary committee next Wednesday April 15th 2015. Everyone needs to contact the Senators on the Judiciary committee. Here is the link to the committee: http://www.flsenate.gov/Committees/Show/JU

Do not underestimate the importance of voicing your opposition to this bill. It has moved through the Banking and Insurance committee by a vote of 8 to 1. It is time to join the fight! No one will help us fight this fight the way we need to.

If you are a Florida shop, you should be calling the members of this committee TODAY. The committee meeting is scheduled for 2PM Wednesday at the Capitol.
