what to do...advice please

I bought a timeshare at one of those presentations....yea i know...well the guy kept telling me i was getting it below market value and he wasnt making any money off of it...hmm.......They threw a lot of stuff at me when i signed. the mortgage purchase price shows 8900 but he told me the purchase price was 8000 and the extra 900 was toward a bonus vacation. when i went to schedule the bonus vacation they tell me i have to pay for it and that it wasnt included in the original timeshare purchase.......i opened up an incident ticket to fix the price...never recieved a response on it....fast forward 3 months...my mortgage modification papers for the extended interest free payments came with the correct amount on them 8000....silly me...i thought they fixed the problem...i got the papers notarized and have been paying the monthly payments per the mortgage agreement for 4 months now...i called to check and make sure my balance was going down and they told me they made a mistake on the mortgage agreement and want me to sign a new agreement with the orginal amount....

would like some advice on how to proceed.....they were suppose to fix it in the first place...should i sign it and put in another incident ticket to fix the original amount.... or just let it go and treat it as a lesson learned...actually do i have to do anything at all...dont they have the power to adjust the contract without my sig...

Hi, welcome to the TOC....if you could give us more specific info re: who you supposedly purchased from, if it is a corporate or independent....we need to have specifics to give good advice....Chances are there is someone here who can help you.

oh..i thought i couldnt do that...

it is westgate resorts park city..i purchased last year around may....initially the contract was interest free for 4 months then if i put down 50% of total purchase price 12 months interest free on the remaining balance.....the problem i'm having is with the orignal purchase price....it should have been 8000/ somehow turned into 8900..but the contract modification showed 8000......and they now want me to sign an modification agreement for the orignal 8900...the salesman doesnt work there anymore

I know there are folks here who are familiar with Westgate props....but my first thought has got to do with maintenance fees. Did they roll in your first year of MF into the original "loan"?

Mmm. Doesn't sound like a smart idea to change it to $8900, especially if there's no written evidence that the $900 is for a bonus week, which you can't book anyway without forking out more money.

i'm wondering if i have a choice...she just told me we are going to send you a document that shows the corrected amount...i have to sign, get it notarized and send it back.....

The purchase was in May and they want to send you documents 10 months later to up the price by $900 for a bonus week?

I'd tell them to take the bonus week and shove it.

You certainly don't need to pay another 10% more on what was an expensive developer purchase. If it was a sales error then their sales department will have to eat the difference. You posess the legal documents that state your price at $8000.

I'm sure a Westgater will be along soon enough with more knowledgeable answer.

Hang around and we'll help you make the best use of it. Is it a winter ski week that you bought? Do you intend to use it each year? What size is the unit?

Westgate or CFI is one of the "bad boys" in my book. They want you to sign off on paying $900 more so they can legally collect it ! Tell them NO. If they don't like the way things are, tell them that voiding the contract and returning all your money is a viable option. Westgate may have a motto of "never give a sucker an even break", and I suggest you treat them as they will treat you.
